Terms of business

Terms of business of Amandaras online-shop (www.amandara.de) presented by Amandara M. Schulzke, Schulze-Boysen-Strasse 34, 10365 Berlin.

§1 Coverage

All our terms of business are currently and exclusively valid in their actual conditions and formulations at the moment of an order from our online shop. All other conditions and formulations of the buyer or orderer which differ our vary from our terms of business have no validity at all.

§2 Conditions and signing of contract

The order of our products has a binding character. We can accept it, subject to our choice, within a time limit of 3 weeks through a confirmation by email or sending it via post service. If there is any writing, -print or calculation mistakes on our websites than www.amandara.de is authorized to resign from the contract.

§3 Price-/ Product changes-, as well as reservation of delivery 

The current prices of our products are valid. They contain legal German value added tax plus the costs of postal service and forwarding costs. Subject to our choice we keep ourselves before, not to assume merchandise-orders, just as not to execute these with lacking availability. The customer is informed in this case instantaneously and already achieved payments will be paid back to the customer.

§4 Payment/ Delivery/ Forwarding costs

The delivery takes place against prepayment to our Account. With your order, you accept the following conditions.

To Germany:
 3, - € as consignment or trade example/by letter, max. 0,5 kg
 7, - € as DHL-Parcel, max. 28 kg
13, - € as C.O.D. (Cash on delivery), max. 28 kg
            (additional the German DHL takes 2, - € Charge with transfer)

 EU-Countries:
17, - € as DHL parcel, max. 28 kg

To Switzerland
30, - € as DHL parcel (5 kg)

Other than EU countries:
32, - € as DHL-Parcel (5 kg)

If the shipping should take place in several stages, we calculate the shipping-expenses of course only once

Depending on worldwide varying forwarding costs, we will answer, by request of the customer, how much the costs will be, depend on weight and value of the order.

Our articles are not always-immediately available but normally within 24 hours until 7 days with availability after order and money entrance or prepayment, they will be delivered. 

Please pay attention: Within the product group “Leather”, the delivery time can have an amount until 3 weeks according to the wished paned model. Products from this group can be changed individually. If the size, weight or form of a product is changed by the customer’s individual introductions or ideas, then the delivery-time can amount from 3 to 5 weeks. Payments for this group of products then depend on individual agreements. The customer has than immediately complain transportation damages by his postal service or deliverer.

§5 Proprietary-reservation

Up to the complete payment, the ware remains property from www.amandara.de.

§6 Revocation right

This clause is only valid for customers; this means each natural person that does a legal-business to the purpose completes, that of neither her/its/their industrial nor her/its/their continuous activity can be added to.

(1) The customers can withdraw the contract-explanation within 14 days without any reasons by text-form (e.g. by letter, email or fax) or through return sending of the ware. The period begins with receipt of the ware. To the maintenance, the timely dispatch of the retraction or the ware suffices the retraction-period. The retraction is to be directed at: Amandara M. Schulzke, Schulze-Boysenstrasse 34, 10365 Berlin, Germany.

(2) In the case of an effective retraction have the on both sides received achievements to be granted back and if necessary drawn utilization must also be given out. Shipping-capable parcel are to be send back. With a return from a merchandise-delivery, whose order-value has more than 40,00 €, the customer has to carry the expenses of the return.

(3) If the customer doesn't can the received ware completely or partially or in made worse condition grant back, the customer must achieve us value-substitute insofar if necessary. With the surrender of ware, this is not valid, if the deterioration exclusively on their examination - as it would have been approximately possible in the store-business – is to lead back. The customer can avoid the value-liability, in which he/it doesn't take the ware like an owner in use and omits everything, which impairs their value, in the remainder.

§ 7 Guarantee

The lawful guarantee-duty is valid. Damages-claims for immediate and/or indirect damages are impossible as far as resolution or coarse negligence doesn't fall us to the load. To do the validity of guarantee claims- and liability claims is the presentation of the original-bill necessary.

§8 Data protection

The entire data-transfer of the sides of www.amandara.de is encoded with an SSL-128 Bit procedure. This is the safest (in the framework of the technical possibilities) procedure. We use the customer’s referential data exclusively for the treatment and handling of the product order. With non-payment the merchandise-delivery and or the consequence-expenses (e.g. dues of the reminder) the data will be sent at corresponding institutions (e.g. Credit inquiry agencies, lawyers, police or collection offices) for collection to the charge as well as to the piece of information referred.

§9 Legal election 

Exclusively German right is valid. Fulfilment place is Berlin. The court-stand Berlin is with contracts with merchants and customers from the foreign countries.

§10 Salvatore Clause

If a regulation should be ineffective, so the effectiveness of the remaining regulations is not touched by it.

§11 Copyright-regulations

The whole contents of this website of www.amandara.de is subject to the copyright and other laws of German copyright regulations, especially all texts, pictures, charts and logos as well as also her/its/their arrangements to the protection of mental property. The author doesn't grant the users the right, that to use prepared texts, pictures and charts on this Website for journalistic purposes in the framework of the current press - and copyright completely or excerpt-wisely to store and to duplicate. The preparation of a copy of contents to the exclusive private, not industrial utilization is allowed, on condition, that the origin remains clearly recognizable. 

 It is called in §106 I by German Copyright law, forbidden utilization of copyright protected works, to this:

 " 1. Who in others than the legally admitted cases without consent of the justifiable a work or a treatment or transformation of a work duplicates, spreads or returns publicly, is punished with freedom-penalty up to three years or with fine. 2. The attempt is punishable ".
